I NEED A LAWYER

What to do when you've been informed that you are going to be charged or you have already been charged?

If you are already a SANDU member, or you've just filled out and submitted a membership application form to SANDU HQ, you can download and print a Soldier's Legal Guard application form for a lawyer from here.

SANDU CANNOT APPOINT A LAWYER FOR YOU WITHOUT THIS FORM!

SLG APPLICATION FORM

Complete page 1-4 of the SLG form and send it back to us with your supporting documents as listed below your type of case you are requesting legal representation for:

CHARGED BY THE MILITARY

Along with the completed SLG form that you downloaded, you will have to send us a copy of the following supporting documents to enable SANDU to appoint you the right lawyer for your case:

  1. DD1
  2. Sec 29
  3. Charge Sheet and ALL the witness statements
  4. Summons to appear in court
  5. Prosecutors’ name and contact number
  6. Place of court where you must appear
  7. Preliminary Investigation (If there is one)
  8. Board of Inquiry (If there is one)
  9. Statement by yourself of all the relevant facts explaining your concern

All these documents can be obtained from the Prosecutors office at your local Legsato where you are going to appear.

CRIMINAL CASE

(Charged by SAPS and appearance in the Magistrates Court)

If you have been arrested and need a lawyer for a bail application, you must download and complete the SLG form and send it back to us.

If you have been arrested and already released, or if you have not been arrested but you have been charged you must download and complete the SLG form and attach a copy of the following documents, then send it to us:

  1. Bail slip (if you were arrested and released)
  2. Court date
  3. Name and location of Court
  4. Copies of all witness statements and the charge sheet.  You need to approach the Clerk of the Court at the relevant court and request him/her to assist you in obtaining copies from the SAPS docket.
  5. Statement of the relevant facts by yourself explaining your concern.

CIVIL CASE

(Received a Summons from Attorneys)

When you receive notice that you are being sued by another person you must download and complete the SLG form and send it back to us with the following supporting documents:

  1. The Summons informing you that you are being sued.
  2. Statement of the relevant facts by yourself explaining your concern.

When you want to sue another person for whatever reason and you seek relief you must download and complete the SLG form and send it back to us with the following supporting documents:

  1. Any documentation related to the incident (Vehicle Accident Report, Contract, Photos, Social Networking Messages, Bank Statements etc).
  2. Statement of the relevant facts by yourself explaining your concern.
  3. Name and Surname of the person you want to sue and also his contact details (Telephone number and Address).

NOTE:  When the case is for MAINTENANCE, please ensure that you attach the existing Maintenance Order if you were previously ordered by the court to pay maintenance or if you want to appeal your current Maintenance Order.

APPEALS

If you wish to appeal the outcome of a court case you must download and complete the SLG form and attach the following documents:

  1. Court Transcript of your case (This you can obtain from the Review Office at your local Legsato where you appeared for your case.  You will have to obtain a quotation from your Legsato Office and pay for the transcript before they will issue you with a copy).
  2. Statement indicating on which grounds you are appealing

Please note that your application cannot be processed without the above mentioned documents!
